Terms of Service

2.1 Description: Kloner AI provides AI-driven avatars for interactive simulation, role-play, and training via a web-based interface.

2.2 Beta Access: You acknowledge that parts of the Platform may be in "Beta" or "Early Access." These features may contain bugs and may be subject to change without notice.

2.3 Modification: We reserve the right to modify, suspend, or discontinue any part of the Service (including specific AI models or voices) at any time.

3.1 Registration: You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials.

3.2 Concurrent Seats (The "Unlimited" Policy):

• Definition: Our "Unlimited" plans refer to the number of sessions allowed, subject to the number of Concurrent Seats purchased.
• Fair Use: While we do not cap the total minutes of usage, we reserve the right to throttle or terminate accounts that attempt to abuse the infrastructure (e.g., using the API for automated non-interactive scraping, crypto-mining, or exceeding reasonable human usage patterns).

4.1 Ownership: You retain full ownership of all text, audio, and scenario data you input into the Platform ("User Input") and the specific simulation reports generated for your organization ("User Output").

4.2 Zero Data Training Policy: We generally respect the sanctity of your data. We do not use your conversation data, case studies, or proprietary inputs to train our artificial intelligence models. Your data remains isolated and is used solely to generate the immediate simulation response.

4.3 No Selling or Sharing: We do not sell, rent, or trade your personal data or conversation logs to third parties for marketing or advertising purposes.

4.4 License to Us: By using the Platform, you grant Edpilot Studio a worldwide, non-exclusive, royalty-free license to access, store, and process your User Content strictly for the purpose of providing and maintaining the Service (e.g., passing text to the LLM for response generation).

5.1 Accuracy: The avatars are powered by Large Language Models (LLMs) and Neural Rendering. They may produce inaccurate information ("hallucinations"). You should not rely on the AI for factual accuracy in critical situations.

5.2 Not Medical Advice: Kloner AI is a simulation and training tool only. It is not a medical device and should not be used for actual patient diagnosis, treatment, or clinical decision-making.

5.3 Simulation Only: The scenarios, even those mimicking medical emergencies, are for educational purposes. We are not liable for any real-world actions taken based on training received on the Platform.

7.1 Subscription Terms: Services are available on Monthly or Yearly subscription plans.

7.2 Invoicing: We do not currently process automatic payments via the website. Upon your request to upgrade, we will generate an invoice and provide payment instructions via email communication.

7.3 Taxes: Applicable taxes (such as GST for Indian customers) will be calculated and added to the final invoice amount at the time of payment request. You are responsible for paying these taxes in accordance with the invoice terms.

7.4 Refunds: As this is a compute-heavy service, we do not generally offer refunds for partial subscription periods once a plan has started.

8.1 Our IP: Edpilot Studio owns all rights, title, and interest in the Kloner AI Platform, the Neural Rendering Engine, the avatars' visual design, and the underlying software.

8.2 Feedback: If you provide feedback or feature requests, we may use them without any obligation to compensate you.

10.1 Jurisdiction: These Terms shall be governed by the laws of India.

10.2 Dispute Resolution: Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Kolkata, West Bengal.
